Terms of Service

1. General

These terms of service apply to the use of the Sirius® application ("Service"). 2. Description of Service

Sirius® is a dog fitness and wellness application. The Service offers, among other things:

• Fitness paths and exercise programs for dogs
• Functional tests for monitoring your dog's fitness
• Calendar tool for activity management
• Weight tracking and weekly planning
• Premium content available through paid subscription

2.1. Content Language Availability

The Service interface is available in Finnish, English, Swedish, and German. The language availability of content varies by content type:

• Fitness Paths — Fitness paths are being translated gradually. Not all fitness paths are available in all languages. When a translation is not available, the content will be displayed in Finnish or English. Each fitness path displays flag icons indicating the available languages
• Rest Stops — Rest stop content is primarily in Finnish, as most content consists of videos and audio recordings in Finnish
• Activities — Activity names are translated into all supported languages. Activities are simple labels without detailed descriptions or media content

3. Registration and User Account

Using the Service requires creating a user account. You must be at least 16 years old to create an account. By registering, you agree to:

• Provide accurate and up-to-date information
• Keep your login credentials confidential
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use

We reserve the right to close or restrict accounts that violate these terms. You may delete your account at any time from your profile settings. Account deletion requires that any active subscription has been cancelled or is pending cancellation. Upon deletion, all your data will be permanently and irreversibly removed.

4. Premium Subscription and Payments

Premium content is available through a paid subscription at €9.50 per month. The following terms apply to subscriptions:

• Payments are processed by the third-party service Stripe Inc.
• Your subscription will automatically renew at €9.50 per month at the end of each billing period, unless cancelled before renewal
• Cancellation can be made at any time from account management or through Stripe's Customer Portal. Cancellation takes effect at the end of the current billing period — you retain premium access until then
• Subscription fees are non-refundable once the billing period has begun. No partial refunds are given for unused portions of a billing period
• We reserve the right to change prices. Price changes do not affect the current billing period

4.1. EU/EEA Consumer Right of Withdrawal

EU and EEA consumers have a 14-day right of withdrawal from the date of subscription purchase (EU Consumer Rights Directive). As premium content constitutes digital content, this right of withdrawal is waived once you begin using premium features. By purchasing a subscription and accessing premium content, you consent to the service beginning immediately and acknowledge that you waive your 14-day right of withdrawal.

4.2. Payment Disputes

If you have questions about billing or concerns about a charge, please contact us at info@siriusdog.fi before initiating a bank dispute or chargeback. We aim to resolve all billing concerns quickly and fairly.

• Filing a chargeback for a legitimate charge that was clearly authorized may result in suspension of your account and termination of your subscription
• We reserve the right to recover costs associated with fraudulent or abusive chargebacks
• Access to the Service may be restricted while a dispute is pending

5. Add-On Content

Individual add-on content can be purchased as a one-time payment. Add-on purchases are subject to the same payment terms as premium subscriptions: one-time payments are final and non-refundable.

6. Premium Code

Terms for subscriptions activated with premium codes:

• The code is personal and single-use, unless otherwise stated
• The code is activated during registration
• Code-activated subscriptions may have an expiration period, after which premium features will be deactivated

7. User Obligations

You agree not to:

• Use the Service for illegal purposes
• Attempt to circumvent the Service's technical protections
• Upload harmful or offensive content
• Use the Service to harass others
• Share your account login credentials with third parties

8. Intellectual Property

All Service content, including texts, images, videos, exercise programs, graphics, and software code, is the property of Sirius® or its licensors and is protected by copyright law. You receive a personal, non-transferable right to use the Service. You may not copy, modify, distribute, or use the Service content for commercial purposes without separate permission.

9. Service Availability

We strive to provide the Service without interruption, but do not guarantee uninterrupted availability. We reserve the right to:

• Perform maintenance as needed
• Modify or discontinue parts of the Service without prior notice
• Restrict access to the Service for technical or security reasons

10. Limitation of Liability

The Service is provided "as is" without warranties. Sirius® is not liable for:

• The suitability of the Service content for your dog's needs — the user is responsible for their dog's well-being and health
• Direct or indirect damages arising from the use or inability to use the Service
• The operation of third-party services (e.g., Stripe)
• Loss of your data, except to the extent caused by our negligence

The exercise programs in the application are intended as general guidance. Always consult a veterinarian or animal physiotherapist before starting a new exercise program, especially if your dog has health issues.

11. Privacy

The processing of your personal data is described in our privacy policy. By registering, you accept the practices described in the privacy policy.

12. Indemnification

You agree to indemnify and hold harmless Sirius®, its owners, employees, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from your misuse of the Service or violation of these terms.

13. Force Majeure

Sirius® is not liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, strikes, wars, pandemics, government orders, internet or telecommunications disruptions, or interruptions in third-party services.

14. Changes to Terms

We reserve the right to modify these terms. Significant changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Applicable Law and Dispute Resolution

These terms are governed by the laws of Finland. Disputes will primarily be resolved through negotiation. If no settlement is reached, disputes will be resolved in the District Court of Kuopio. Consumers also have the right to submit disputes to the Consumer Disputes Board (kuluttajariita.fi).

16. Severability

If any provision of these terms is found to be invalid or unenforceable, it shall not affect the validity of the remaining provisions. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original.

17. Entire Agreement

These terms of service, together with our privacy policy, constitute the entire agreement between you and Sirius® regarding the use of the Service. They supersede all prior oral or written agreements on the same subject.

18. Geographic Restrictions

Access to the Sirius® Service from the Russian Federation and the Republic of Belarus is prohibited. This restriction applies to all users regardless of nationality or residence, when the Service is accessed from within these countries. While we cannot technically prevent all access, this restriction is legally binding. Circumventing these restrictions (e.g., using a VPN) is prohibited.

• Access from the Russian Federation and the Republic of Belarus is blocked based on IP address geolocation
• Using a VPN, proxy, or other circumvention tools to bypass geographic restrictions violates these Terms of Service
• Accounts found to be circumventing geographic restrictions may be deleted immediately without prior notice
• No refunds will be issued for accounts terminated due to geographic restriction violations
• Users have no claims or rights regarding accounts terminated under this policy
